Today I’ll tell you about an Apostille in Korea.

Do you know what an apostille is?

"Apostille” is a form of authentication issued to documents for use in countries that participate in the Hague Convention of 1961. In general, after the 'Ministry of Foreign Affairs' and 'Embassy Certification', the reliability of the national document is verified, but there is an inconvenience in terms of time and cost. To resolve this inconvenience, without consular legalization through overseas consulates among the member countries, Apostille has appeared, which recognizes documents with Apostille as legalized documents.

Korea is also one of the members of the apostille convention.

There are two types of documents to be apostilled.

An official document and notary document.

1. Official document

- Documents issued by an administrative agency.

(a legislative body, the judicial branch, and administration)

- Documents issued for the performance of duties by an agency whose status is a public official prescribed in Article 2 of the Government Officials Act or Article 2 of the Local Officials Act;

(Such as family relation certificate, certificate of tax payment, transcripts issued by a public school.)

2. Notary document

- Generally, non-official documents are subject to apostille confirmation by notarization.

- A notary document issued by a person qualified as a notary under the Notary act or the Attorneys-at-Law act.

(Such as a medical certificate, translated document, transcripts of private elementary, middle and high schools)

And there are two apostille issuing agencies.

The Ministry of Justice and the Ministry of Foreign Affairs.

1. Documents available for apostille from the Ministry of Justice.

- A Certified copy and an abstract of a trial or a record containing a trial preserved in accordance with the office Rules for prosecution maintenance.

- A notary document.

 - Documents prepared by the Ministry of Justice or its affiliated agencies (including the Public Prosecutors' Office) for official purposes.

2. Documents available for apostille from the Ministry of Foreign Affairs.

- Documents issued by an administrative agency (Excluding the documents in item 1 above)

Wow… very difficult.

If you decided to get an apostille in person, you’ll have a hard time.

Apostille is only available in countries where documents have been issued.

What if you left Korea without Apostille?
